USPTO response to provisional applications?
« on: 12-07-04 at 03:32 pm »

I have sent via UPS a provisional application to the USPTO over a month ago. I know they received it since they signed the package and also charged my credit card with the fee according to the form I sent in the package. However, I so far got no confirmation email/letter/phone call or anything. Tried to call and fax the OPIE there but phones are constantly busy and my fax got no answer so far.
Is this to be expected or should I get worried that maybe something happened to the application?
Thanks,
Zvi

It is not that unusual for a Filing Receipt or some other notice to be sent well after a patent application is received. The Filing Receipt is usually mailed within 2 months or so. Did you include a filing postcard with your application? If so, that is usually the first acknowledgement one can expect to receive as it is checked and put in the mail very soon after the envelope is opened at the patent office.

To get quicker confirmation, try contacting the Patent Assistance Center of the USPTO:

http://www.uspto.gov/web/offices/pac/dapp/pacmain.html

If you do future provisional or regular patent application filings yourself, be sure to use USPS Express Mail instead of UPS. By filing an application properly following the appropriate guidelines, your filing date is the day you deposited the package with the USPS. With UPS, the filing date is the day the patent office receives the application.
