Publishing is the process of getting your work out to the
public.

Gaining copyright protection simply requires fixing a creative
work in a tangible medium of expression.  When you type the
text of the great American novel into your wordprocessor, the
work is fixed in memory or on the harddrive and is protectable
by copyright.

You can register your copyright and in the US you must do so
before seeking a remedy in court.
