Can I patent this?
« on: 03-21-09 at 06:19 pm »

Hi,

Thank you for entertaining the following question:

If I slightly modify the design of an existing patented product and change its material composition to address a common problem that the original product overlooks,  is this new design patentable?

Moreover, the new material composition for this product would be obvious if the said problem was actually presented to the original manufacturer.  However, the problem which I am addressing is a new one which would have emerged since the original patents for this device.

Hypothetically this can be patentable.

That would not necessarily mean that your invention is not obvious.  Not that it is, but I have no clue, nor will anyone else without detail provided.

There is also the hypothetical chance that you patented product (if and when patented) could still infringe on the existing patent you refer to.

In other words, everything is hypothetical here.
