P2P Services Argue Against Writ

P2P Services Grokster and Morpheus have filed briefs with the US Supreme court urging to the court not to take up the appeal filed by the MPAA and RIAA after they unsuccessfully sued Grokster for copyright infringement.

Grokster and Morpheus argue that since P2P has substantial, non-infringing uses, they cannot be held accountable for any infringing uses that do occur.

So is this settled law, or should the US Supreme court consider the appeal?

No matter what the past precedent, the Supreme Court is not bound
by even it's own precedent, stare decisis notwithstanding.

If the Justices grant cert then the issue isn't settled.

I think Congress is pretty close to resolving the issue legislatively.
Since I think it's easier for Congress to get rid of the dirty
bath water without throwing out baby Sony, I'd prefer that
the Court take a pass on the issue.

Just in case you missed it, the Supreme Court granted cert and
will hear this case.
