I have a recipe for a nutritional bar that is different than any other that exists currently.  Can anyone direct me where to start to best protect such an invention prior to either approaching prospective purchasers or selling this product directly to the public myself?  Can I do it alone with no previous experience?

I suggest that you meet with an attorney to get an understanding of what a modes of protection are potentially available for your nutritional bar.  Varous combinations of trademark, patent, copyright and trade secrets have various costs and timing associated with them, and offer different kinds of protection.

It is possible to file a patent with the PTO with no previous experience.  To get you started, go to the uspto.gov web site and download the application form for utility patent.  Let me know if you need more help.

One more thing.. if you decide to sell your product before filing, do not wait for more than a year after selling it; otherwise you would not be able to get the patent later on.

"One more thing.. if you decide to sell your product before filing, do not wait for more than a year after selling it; otherwise you would not be able to get the patent later on."  This advice is incomplete.  If you disclose your idea publicly, you lose your right to apply for a patent in many, perhaps most, foreign countries.

Why do you think your recipe is not obvious?  I have never seen a patent on the typical recipe that one might use at home.  Maybe they exist, but I haven't seen one.

Why don't you consider protecting your recipe as a trade secret?  That's what Coke does for their sugary drink.

Since I have originally posted this, I have done some research and spoken to an attorney briefly.  It turns out a trade secret is what I need.  I greatly appreciate the last 3 posts that were made.  Can either of you give me any information on how to begin filing a trade secret on my own?  Is that possible?  Do you have any reading material you can reccomend also that might help  educate someone with a non-legal backround as myself?

There are no forms for trade secrets.
