Can I still get a new patent?
« on: 01-05-09 at 04:39 pm »

I have an idea for a product but I find that someone already got a patent on it around 14 years ago but they never produced a product. My idea is very similar and end product is same. If I make some changes in the process and make functioning of some of the parts/aspects unique, can I still get a patent on my idea so that I can build and sell the product with some kind of protection? I intend to make my product more high tech than the original idea? Will that help in getting a patent or no?

You can only get a patent on a non-obvious variation of the prior patent.  If you're making it more "high tech" in a non-obvious way, that helps.

Regards.
