Dear TS,

Each situation is different. Business volume under a mark is a place to start. Prospects under the mark is the place to go.

The courts respond to evidence.

Years ago "Scarves by Vera", was a trademark. Today, as I understand it, there is a Licencing organization, earning or grossing $100M a year on the mark "Vera".
