I want to use an already "Word Mark"ed name

I am seeking to operate a business in the exact same name as that of an already "Word Mark"ed name. My business is also in the same industry. If my name (the same as theirs) is "Audio America" can we both use it for stereo repair service industry? What about names like "Joe's Auto", "Electric Connection" etc. Their business is on the east coast and ours is on the west coast. The industry in which we provide services is regulated by the state and requires a license, which they do not currently have in our state. Is it safe to conduct business until we get a letter? Please advise on a solution, we want to use the name.
