Trademark Question

Posted by Pawel Mazurek on March 14, 2001 at 06:48:57:

I recently received a letter from a lawyer ordering me to stop using my company name and the URL associated with that name. His client apparently runs a company with a similar name.
As far as I know neither one of us has registered or trademarked our company logo's or names.

EX:
His Co. name is "fathead ******"
My Co. name is "fathead ******s" my name ends with an s

I never knew that his company even existed until I got the letter from his lawyer. I tried to check the federal trademark database to see if that name is registered. I came up with 0 hits. The name "fathead" has been registered by several different parties, but not fathead ****** or fathead ******s.

My question is does he have the right to my domain name or is his lawyer just trying to push me around. I'm a small one person operation and my business is a side gig. Not my full time job. Should I get a lawyer? Is it worth the time and money?

Thank you
