Losing Business Name?

I opened a retail business 10 years ago.5 years ago I went to strictly wholesale only.Someone I know opened a store 10 miles down the road from me six months ago. They are selling the exact same things I am and they have taken my business name word for word. My name is registered with the state. They told me they could legally do this since I no longer have a retail store and that I don't advertise.Can they do this to me? Can I still operate using the name I created even though I don't advertise. Help?
