Dear Tammy,

The best way is to be able to apply the law to the situation so that you know what to do and how to do it effectively.

A good start is an Intellectual Property lawyer you can trust.

For instance, it is possible that the hat is patentable. It is important not to divulge or use the invention before a patent application is filed. In most of the rest of the world no valid patent can issue.

If you are going to make and sell the hat whether or not is it patentable, the start is a trademark search to see if the mark is available.
