James, an a purely hyophetical basis, this will depend entirely on the scope of the prior user's service marks.
You failed to mention whether the mark was registered federally or just in one state.
If it is federal, there is probably a real infringement issue (you might want to consult with a
lawyer as there are some complex laws about how a federal trademark can be
geographically limited to a certain area). If it is just a state registration and the
senior user is only operating in that state, and the junior user adopts the mark in
another state, there may be no infringement at all.
