R in a circle is a statutory notice of a Federal registration of a trademark. Its proper us is binding without actual notice.

TM is for the more sophisticated. If you are using a mark TM identifies that you are making a claim for this a s trademark. It may serve as a warning that an application has been filed.

There is not statory effct.
