Service vs trademark legal loophole

When two different entities own the same mark for
differenct purposes (service vs trademark) there seems
a flaw (loophole) in the law.

For example, if "Creative Master" is owned as a service
and as trademark, what prevents the service company
from putting its service mark on goods (on the box)
with a phrase such as "Crafted by Creative Master(SM)"?

It seems you can essentially use a service mark as
as a trademake on goods by stating you are a
"crafter" or "marker" performing this service.
