Scenrio:
A manufacturer has registered its trademark used on
cars it manufacters and sells (example Oldsmobile).
The mark is registered for the class of goods (cars).
If another entity has registered the same mark for
use in another class (toys), is the manufacturer of
the cars prohibited from using its trademark
(Oldsmobile) as it would be included on miniature
replicas of its product which would include the
"Oldsmobile" name?
