I have a Calif. corporation founded in 9/92. Not trademarked or copywrited. A company on the east coast, with a similar - but definitely not the same name, has copyrighted their name (approx 10 years ago) They do a different type of business, also loans, but of a different type. They now want to come into California and have ordered me to cease and desist using my corporate name. and have offered me a token amount of money to do so. They have deep pockets and if I don't agree by today, they will file their complaint tomorrow. Question: can I get this suit continued repeatedly so I will have the benefit of using my name for a longer period of time? I would probably lose the suite, so I'm trying to decide if there is some way I can be a terrific nuisance, so that they would rather pay me a more reasonable amount of settlement to discontinue my name.
