My client would like to trademark a phrase that describes
a software system. The phrase is three words long and the first letter
of each of the three words forms the acronym ERS. In the same industry,
ERS is trademarked, but does not stand for the same phrase my client would
like to trademark. When writing about this system in sales collateral,
etc., is it illegal to use the acronym in parenthesis
after the phrase and to continue using the acronym throughout the
publication instead of writing out the whole trademarked phrase
since the three letters are already trademarked for something else?
Any help you could provide would be helpful. Thanks.
