: : : A few years ago I wrote a small windows game, which is free, called 'Yahtzee for Windows'. This game has been very sucessful, resulting in a high demand. I have received an email from Hasbro today, demanding that I remove all reference to the game from the internet (where it can be downloaded to install on the individuals PC), within 10 days, else they will take further action. Can anyone tell me what I can do, ie. name change (one which still sounds familiar maybe?), and also where I stand if the game is being hosted on a web site not owned by me, and which I have no authority over. What can Hasbro do about this? Also, is the actual game trademarked? or just the name 'Yahtzee'? (surely you can't trademark a game like yahtzee?, maybe tic-tac-toe is trademarked too!)
: : I don't follow games. Yahtzee sounds familiar. If Hasbro is hassling you the chances are they have a registered trademark. They probably should have refered to it in correspondence. This can be checked.
: : The trademark can be checked. If you rename it with any name that is likely to be confused with Yahtzee you are still in difficulty if you are in difficulty. If you have made no profit they may only be able to stop you. If you have no control over others use of the mark you may be home free. The game is not trademarked only the name of the game. Tic tac toe is probably in the public domain.
