I would like to sell T-shirts with a certain logo on them that I would like to federally trademark. Another company has a federal trademark for the same logo for hosiery. That's all they sell. I do not want to sell hosiery. However, we would be is the same IC class (i.e., 25). Is it likely that the USPTO would grant me a TM for T-shirts if I disclaim the selling of hosiery? Thank you.
