I have been informed that the elimination is considered intellectual property. Can you trademark an activity such as the elimination process? : : This company is requested that I pay them $5,000 to put on my event because it constitutes the elimination process which they state is intellectual property of thiers for over 20 years. If I do not include in the name of my competition the words "tough" could I get by with changing some of the "format" to have a different elimination process and longer or shorter timed rounds; would this still be considered trademark infringement? What does the Lanham Act have to do with all of this? : : If I am not allowed to put on this event, please explain why we can have Wendy's and McDonald's both selling hamburgers or Coke and Pepsi both selling cola drinks. : : Thanks for your help in advance. : The facts seem uncertain.
