: : I intend to register a Trademark for a brand name for a clothing line I have designed.I am reasonably sure that no one is using this name as a line of clothing. However, there is someone who has a corporation in the same name, but it is a totally different business. They are offering a service.

: : Question; Can i still proceed with my trademark application if somebody has their coporate name the same. Two totally different businesses.

Dear Mr. Gill,
You are on the right track as far as the tradename, is concerned, it should not stand in the way of the trademark, though it may be a waringing signal if the tradename is for a competitive business.
