-After being in business for two years Company "A" registers their company name, "international voice services". The company name is a desriptive name containing three works pertaining to the service they offer using plain english.

-Other companies have the same name or use the three words to describe the product or services they sell.

-Company "B" is also in the telecommunications business but of a unique name and registers the URL on "www.InternationalVoiceSerivces.com" on the open market and points to company "B"'s web site. The URL was registered two years after "A" established the trademark.

Questions:
1. Does "A" have any right to the URL?
2. If company "B" offers to transfer the URL does "A" have any rights to damages and if so what proof is needed to prove damages.

Thank you for your input,
Chuck.
