: -After being in business for two years Company "A" registers their company name, "international voice services". The company name is a desriptive name containing three works pertaining to the service they offer using plain english. : -Other companies have the same name or use the three words to describe the product or services they sell. : -Company "B" is also in the telecommunications business but of a unique name and registers the URL on "www.InternationalVoiceSerivces.com" on the open market and points to company "B"'s web site. The URL was registered two years after "A" established the trademark. : Questions: : 1. Does "A" have any right to the URL? : 2. If company "B" offers to transfer the URL does "A" have any rights to damages and if so what proof is needed to prove damages. : Thank you for your input, : Chuck.
