What do we do now? posted by Cynthia on January 08, 2000 at 17:34:40: : In the message that follows from me (see who has precedence), I guess I must have had good intuitive sense of something occurring. From this site, I did find the free online database of trademarked names. I did a search. Lo and behold, there has been a registration of the name -- I'll say it -- The Canine Times, wtih registration effective 11/99, by the company Canine Times LTD. They indicated start use in commerce of 11/97. In 8/97, or so, they registered domain of caninetimes.com We started use in commerce 3/97 and can prove it. We've been using the name caninetimes in subdirectory, but most importantly on our publication since 3/97. : Is it too late to stop this? Should we even try? If I'd known earlier, in the 30 day period, I would have protested. I'm positive they know about us. Positive. What triggers us being alerted? Should they have alerted us? I can't be checking databases daily! Are we looking at thousands of dollars to keep the name of our well-known and popular publication? Anything I can do immediately and easily? : I have advertisers lined up the next three months in this weekly emailed publication. Am I suppose to rename immediately or ?? : Furious, but yep, we should have trademarked it sooner. Now we know. : Please advise.
