: : : : : : : We're in the process of starting a food business where we will produce several lines of product. Do we need to trademark our business name or the name of each product we come up with? For example, say the busines name is "grandmas foods" and we create and sell "grandmas grape jelly", "grandmas extra sour candy" and so on. Do we trademark "grandmas" in the jelly and candy categories, do we trademark "grandmas foods" in each category, or do we trademark each product name in its category? Your insight is appreciated.

: : : : : : Dear Molly,
: : : : : : You out to select a GOOD trademark before you start to sell. Make sure the name is not in conflict with other similiar users. One mark can be registered for in one class, or all the various classed the mark is used in. Trademarks are forever as long as you know what and how to do.

: : : : : So am I trademarking a word or a symbol? Would I want to come up with a cool way to write "grandmas" with a recognizable symbol and then trademark it, or should I trademark just the word "grandmas" before we come up with any products?????

: : : : Dear Molly,
: : : : The first thing to do is to have a trademark search to see if you can use Grandma's.

: : : I'm past that point. The word isn't "grandmas" and the word I want is not trademarked in the IC cagegories I want. But still back to my original questions, would I trademark "grandmas", "grandmas foods", or "grandmas sour candy"????? Am I correct to assume that if I trademarked the word "grandmas" in the jams and jellies IC, then no one could come up and use that word in their jelly product? Or would someone just be able to come along and name their jelly something like "grandmas best" and not violate my trademark to the word "grandmas"?

: : Dear Molly,
: : I sympathize with you desire to save money on Intellectual Property matters but from what you say, it looks to me as if you have no concept of the legal significance of what you are doing, even whether or not you are on the right track. I'm not saying you are or you aren't.

: Dear Molly:

: I have to agree with Arthur. You need legal advice on the matter. You would loose a lot more money if you go into business without securing the best available protection to your investment in a brand. Find an attorney who suits you.

: Yours truly,

: Miguel Baez

Dear Molly,
I am proud of your good advice, only there is another factor, you MUST be able to find a lawyer you can trust. Just as with people generally, there are some that are out only for their profit and there are some that are out to render valuable service to others. Both good and bad lawyers still have to be paid.
