: I want to incorporate my business, trademark the name, and register the domains for my company name. We provide highly specialized services for a small segmant of merchants. Unfortunatly there is another individual using a similar name with similar services to some of ours on the internet. This individual has not filed for a trademark and (appears) to be a DBA. However he does have a website in place and is doing business across state lines. : I am afraid that I might be spending a lot of money only to have this individual de-rail my business. Can I still move ahead or should I consider a new name? Would I prevail in court by doing as I stated above or does the fact that his company name is the same as mine sans a leading "e" and having a website in place doom me to failure? If I purchased an existing domain name that was registered prior to his use of the similar domain insure my success or is the same thing? : Any help would be greatly appreciated.
