New Trademark vs. Former affiliate account[ Follow Ups ] [ Post Followup ] [ Trademark Forum ] [ FAQ ] Posted by Anna K on September 02, 2003 at 13:17:48:
In 1997 I became an affiliate for the company XYZ selling a specific product. In 1999 I registered a domain name that is exactly matches the name of the product and started to refer customers to the above company. Everything went well until I got a cancellation letter from the XYZ comapany cancelling our affiliate status. The owner closed the business and opened a new company ZZZ with a different name. They started selling the same product again via direct advertising. In the meantime I became an affiliate for a different company ABC that supposedly registered a trademark in 2002 which my domain name was part of. In 2003 this different comapny "ABC" sold trademark to the newly formed ZZZ company. Now ZZZ comapny is trying to get all the domain names that match the trademark partially or in full and would like to get our domain name as they beleive we have no rights to it. I have invested quite a lot of money in to web site development and domain name promotion in the last 4 years. I know for sure that the owner of the first XYZ comapny is one of the owners of the new ZZZ company. I've been growing business for these companies (which I can prove since I kept the records of all forwarded orders since 1999) and now ZZZ would like to get a domain name that is known and promoted. By the way my TLD is not .COM. The .COM TLD was aquired for the money by the ABC company from an individual and later sold to the ZZZ (former XYZ)company. Any suggestions ??? Any thoughts will be appreciated. Thanks a lot.
