Deadline to oppose[ Follow Ups ] [ Post Followup ] [ Trademark Forum ] [ FAQ ] Posted by Joe on August 21, 2003 at 04:37:06: Article 1503.03 of the Trademark Manual of Examining Procedure states that "An opposition must be filed within thirty days after the date of publication in the Official Gazette". On June 10, 2003, a notice of a specific trademark filing was published in the Official Gazette. The filing went unnoticed by potentially opposing parties until last week. The graphic item that was trademarked has previously been considered a symbol in the "public domain". For years (perhaps even a decade) it has been used by countless parties to signify their support of a particular cause/movement. I understand that the 30-day deadline to file a motion of opposition has passed. My question is: Has there ever been an instance where the Trademark Trial and Appeal Board has chosen to accept an motion of opposition BEYOND the 30-day deadline (without the benefit of a properly filed request for extension)?
