They want to track how the URL left the control of their entity and wound up with someone else. They have the trademark to the URL but they don't have it any longer. : : I am confused. These are the facts as I understand them: : Your client owns a trademark. The trademark corresponds to the URL. Your client even owned the URL. However, the URL either had a lapse in registration or was outright stolen. Either way, its gone and you want it back. : My solution: : Get it back! Who cares who has had it? Find out who has it now and get it back. If you are an attorney, you may wish to send a cease and desist letter to the owner. However, if the current usage is a valid business concern and there is no sign of fraud or sketchy dealings, you might have a tough time getting the URL back.
