A domain name is not the same thing as a trademark; however, potentially someone who has owned Coca-cola's Barber Shop for the last 60 years has the same right to cocacola.com as does Coke.

So if the person who knabbed your URL hasn't trademarked a name for use in a legitmate business, you have a leg to stand on under the cybersquatting provisions. If they have created a legitmate business name/trademark to go with it, I would say things are much, much, much more sticky.

Either way, you should have never let your URL lapse.

BTW: I am not a laywer. But I have been working as a Web developer/marketer for years.
