The case:

I've a federal registered trademark for "FOOBAR". Someone has applied to trademark "FOO2BAR" (the 2 in the middle of the words acts as a shortcut for the article "to").

They describe their mark as related to applications or software that manages employee performance - I offer web design services.

Their case is still pending so I don't know whether it will be registered or not.

Can I effectively oppose their trademark as very similarly confusing to mine, even though our industries don't exactly overlap?
