: Thank You for your reply - your answer is exactly what I expected. I've been trying to help people on eBay regarding infringement, but had never run into it regarding descriptions before. This is what that particular company has to say about this person using their trademarked name in his/her description: : "While it may be true that the products that you advertise on eBay contains mark, prominent use of the [mark] in the headline or description, nevertheless, falsely suggests that your use of the mark is : sponsored by or affiliated with the [trademark company]. : : In order to protect the distinctiveness of the mark and name, our client must prevent any unauthorized use of that mark. For those using the mark in an unauthorized manner, our client requests that the party cease any and all use of the mark and name, and any mark similar thereto, in any manner." : My suggestion to this person is to file a counter notice via eBay, and have this company respond. I also suggest that she states in her auctions that the "auction is neither endorsed nor affiliated in anyway with said company". What do you think?
