Hi,

I'm closing in on a beta version of my product and wanted to make sure that I can use a good title for the product.

It turns out that someone has already registered a name similar to the title I want to use. However, they have it registered in the "Education and
Entertainment" category.

While my product does relate to "Education and Entertainment", it deals with
software and therefore I can register it in the "Computer Software"
category at the very least.

My question is whether anyone has gone about registering a name similar to
an already-registered trademark, but in a different category?

Secondly...if I register it under the computer software category...does
their company have legitimate claims against me? We are both approaching a similar audience -- except I tackle the challenge via software and they've
created books on it.
