: : Can i apply for a trademark for a name, use it in commerce, and still be protected? I want to start a clothes line based on a name. I am short on funds, and want to send out samples, but I don't want to loose the name/logo- : : Thanks- Aaron The answer is yes. The first thing to do is to conduct a search so that you have a better idea whether or not you are infringing any trademarks. If that looks safe and the mark also looks registerable, then a proposed use application will cover the start up period. The way to protect your funds is the search. Down the line it can really cost, if you are infringing or cannot register the mark. Make sure you have enough to get going keep going and to pay taxes out of your csh flow. The whole picture has to be considered. This is not to worry you but to alert you. I had a personal friend that went into business got a multimillion dollar order and went down the tubes immediately. He could float the capital to handle the order. M.
