: We have recently set up our company, and have just been contacted by someone else to say we are using their company name. Apparently this has happened to them before and they've contacted their solicitors and wish to take legal action. : : For example,imagine the company name is drinks r us, could we market as drinks r us.com and not be accused of passing off? They are not registered at companies house or as a trademark, and as long as people didn't confuse it would it be ok? We did all the research we could beforehand including full internet researches and found nothing, so this is completely innoncent. : However, we are now extremely well listed on the internet (which they aren't at all) so if anything they benefit from our good name and not the reverse!
