I have a few questions concerning trademarks, comic books in particular.

1) If I trademark a title like say for instance 'X-Men' would I need to register individual Trademarks for the individual characters that appear in the book?

2) If someone has chosen a name for their company, published under this name, but has not registered for anything but a domain name, do I have the right to publish periodicals under the same name if I trademark the name for paper publication first? Would they have a legitament case if they contest my right to use it?
