after all the expense and effort we went to to successfully get a Federal trademark, we did not renew when we were supposed to. as of last year our trademark "died". so what to do? is there a process whereby we can file a claim that we did not purposefully abandon the trademark (we have continued to market the service)? if we want to revive it must we reapply as if we never had the trademark? wouldn't the fact that we were the first to use it and to get a trademark help in re-establishing our rights to it? one last question. we heard that there was such a thing as common law rights. do these apply to our ownership. if the trademark was granted at the end of 1993, does that mean we still have some rights until 2003? any help would be appreciated!
