In February of 2001, I opened a photography rental studio. In sept of 2001 someone else who had incoporated before I obtained my DBA (identical name) and spent a year renovating, opened up for business. If I was doing business and promoting the same name studio, including published advertising, can I keep the name? Is conducting business first more important than who obtained the name first? If I know the other party has bigger financial resources than me, should I try to have them buy out my right to name Vs going to court or facing their cease and desist for me?
