Is there sanction against someone showing the Circle-R next to a word mark that is not a Registered Trademark?

Suppose someone has a registered trademark (not actual example) "Peachy Keen" for a fruit slicer and someone else wrongfully (no registration) puts a Circle-R on "Peachy Keen" brand of peaches (not same goods). Does the registered owner of the fruit slicer have defend his trademark by filing a complaint against the peach packer?
