Trade dress protection is available as a subcategory of trademark
(coca cola's uniquely shaped bottle is trademarked as are many forms of package designs);

A design patent may also be available for functional goods that have integrated functional components - any non-functional (aesthetic) components of such goods would fall under trade dress.

EXAMPLE - A cuckoo clock with a Peacock rather than a cuckoo. . . To the extent that the clock tells time = function; ) - the non-functional design integration of the peacock = trade dress.
