: I have a name and a great advertising campaign for a product that doen't exist yet. Would a trademark help me if I were to propose this idea to a major company? And how do I go about getting a trademark? Or how would I go about this. Dear Betsy, Years ago I had a person friend who had a great idea for advertising a product. I went to the company, they referred me to their advertising agency. The agency said, "This is what we are paid for and this is what we pay our people to create. We don't even want to look." You can apply for a proposed use trademark. The law, though is designed to only protect marks that the registrant intends to use in a bona fide business, not to apply and try to sell. If you are full of ideas, open an idea business or get a job in an agency or a promotional firm. If what I say here sounds callous, it is not, it is only true. M.
