: : : : : I am an investor interested in outsourcing patent and copyright law offshore. If offshored to India, everyone can benefit. Has anyone heard of this before?

: : : : What exactly do you want them to do? If you want patents in India, that's the way to go.
: :

: : : Dear Mr. Ivey,
: : : Are you suggesting that getting a patent in India is of any value in the US to a citizen or resident unless they are going to use it in India? I have not checked, but I suspect that India is not even a Member of the Paris Convention.

: : : M. Arthur Auslander

: : I assume you're referring to the portion I left above. My point is that the only purpose I see in having a patent application drafted in India (or any legal services performed in India) is to have intellectual property in India.

: : It's not like outsourcing software development where it doesn't matter who wrote the software as long as it works according to specification. Each country has it's own set of laws.

: : Now, whether an individual wants IP in India is up to them. A number of my clients do want that -- American or otherwise.

: : And, India is a member of the PCT. Has been for a while.

: Dear all,
: I could not understand what u all exactly mean by outsourcing IP to India. As far as I could understand, it means outsourcing all patent drafting, patentibility evaluation work to india and filing the patent in US by US attorney who is getting his work done in india at low cost.As far as filing in India is concerned, thats a separate issue and doesnot comes under outsourcing IP to india.

Dear Mr. Arora,
This issue is what have, what you want to do with it and the cost.
The rights have to be protected in the countries of interest. JUST getting a patent, does no mean a thing. The patent have to be a good patent unless you are interested in a commercial scare crow.
