In re Golden Books Family Entertainment, Inc., 269 B.R. 311 (Nov. 8, 2001). Okay, so it was almost 2 years ago.... I can e-mail you the full news report if you like. Regards. : : How can I make the research paper I have to write for my Bankruptcy class have something to do with Intellectual Property? : : any ideas???? : Yes, about a year ago (maybe more, maybe less), there was a case in which a license which was non-assignable (by its own language) was nonetheless assigned during bankruptcy (the license was an important asset of the bankrupt company). The assignment was upheld. It was big news a while back. : I don't practice that type of law, so I don't have the name/citation handy. I can look it up (or maybe that's enough information to search for it yourself??). If I recall correctly, it wasn't a particularly authoritative court (maybe a district court or a non-Supreme state court). It was still quite controversial for people doing licensing work. : I also don't know whether other courts have followed it or whether anyone has looked into the likelihood that the case will be followed. But that would be a very interesting article. I'd love to see it when it's done. : I hope that helps. : Regards.
