Sorry, I'm a newbie ! posted by James Ivey on August 24, 2003 at 13:07:01: : : I am curious as to whether an "idea" can be protected even though there is no "real" design. I remember the IT Wars of the 80's when "look and feel" was a big issue and companies were trying to protect ideas like pointing and clicking. : : I would like to protect our simple idea and maybe even earn some dollars at some point in the future. : : Any comments? : : Patents have very specific limits as to what they cover. These are described in the somewhat archane looking numbered "paragraphs" at the end called "claims." I doubt very seriously that any patent issued in the last 25 years covered something as simple as "point and click." : To get the patent, you have to be able to describe the invention covered by the claims in sufficient detail to enable one of merely ordinary skill to make and use the invention. In addition, the invention must be new and more than a mere obvious deviation from what has been done (and/or disclosed) before. : If you can meet all those requirements (and a few more), you can have a patent. I'm still filling in the content of my web site, but I have an older write-up that may spell things out a little more clearly here: : Regards. Dear Mr. Ivey, M. Arthur Auslander
