: : I HAVE HEARD OF THE "POOR MANS PATENT" AND I WANTED TO KNOW HOW TO OBTAIN ONE ? Dear Ms. Kilgore, The one effective "Poor mans patent", is a court admissible proof of concept. The only protection is against the use of the invention by someone who has had a confidential disclosure and violated it. If there is a court admissible proof of conception it may be useable to establish a date of conception prior to the date of another applicant. A valid patent application in the US must be in the name of the inventor or by a valid assignee of all of the rights. M.
