If your husband wants to be a patent attorney he should be a patent attorney. Secondly, with regard to taking the exam before lawschool; if your husband can pass the exam then go for it. Remember however, it is extremely difficult and it is a law exam, it is not a science exam. I am taking the exam this October, after graduating this past May. Ideally I wish I had taken it my second year. Having seen many old exams I believe having a year or year and a half of lawschool behind you would be a tremendous benefit to helping pass the exam. Good luch with which ever route you choose.
