It is not the lawyers job to determine the value of an idea but there are some ideas the are obviously unprotectable. There are some lawyers that make a fortune protecting valueless ideas. It may not even be malpractice to get a patent that is of no value. there is a $100M+ a year getting patents that are are no value and even some patent lawyers engage in such practices. M.
