Confused about patent versus Infringement[ Follow Ups ] [ Post Followup ] [ Patent Forum ] [ FAQ ] Posted by Jerry on April 07, 2003 at 02:00:51: I am a little confused about patents. I thought up a new idea but I don't know if I can get a patent on it. The idea/invention is new, but how it is used is not. Can I still get a patent? I don't want to share my idea on this forum, but let me give you an example of what I am talking about. Suppose I develop a new tire gauge to check the air in tires. Suppose that the device is so sophisticated that I can check the air prussure without having to even touch the tire. The invention is different than other previous air gauges because I do not have to slip anything over an air nozzle to get the tire pressure. Would the emboidiment of my invention(Tire Gauge) be denied a patent because tire gauges already exists? I am thinking that it might infringe on previous patents, but still be patentable. If someone had a main broad claim like: A device that checks the pressure of tires. I am thinking that my new invention might infringe on an old idea, but still be patentable.
