Ok, prior art is a VERY VERY broad definition for any evidenciary matter that can be used to anticipate or obviate an Applicant's invention.

There are no lines crossed between prior art and new use. WHat you're saying doesnt make a lot of sense, but let me just say that new use for an exisiting technology can possibly be patentable. Prior art comes into play when the PTO finds teachings to reject claims defining your "method of use" invention.

Makes sense?

: ok, the law defines prior art. the law defines new use. what lines are crossed between prior art and new use? how do you determine prior art or new use.

: thank you
