Yes the law defines prior art. But I think there is some confusion on the issue here. There is no law on a new use -- the rule is defined as "new and useful" ! This means the invention must be new and it must be useful. Use is a very easy hurdle to overcome. New is somewhat more difficult.

I would suggest you consult with a registered patent attorney before proceeding should you have any other questions.
