A design patent may protect a bra design or designs if they are new and original. Bras may also be patented if there is something novel in the constuction. You can't patent what is already there. If you legitimately copy what is out there you can make a name for ourself selling under your trademark. There are patents on lingerie. Such patents are on novel constuction and function. Design patent are for what a garment looks like. The problem with a design patent is that it usually takes about a year or more to issue and a season may pass. M.
